1. Accepting these terms
CurbCrush ("CurbCrush", "we", "us" or "our") provides a service at curbcrush.app that turns real-estate listings into short marketing videos. These Terms of Service ("Terms") apply whenever you visit the site, create an account or use any part of the service (together, the "Service").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy, which explains how we handle personal information. If you do not agree, do not use the Service.
If you use CurbCrush on behalf of a brokerage, team or other business, you confirm that you are allowed to accept these Terms for that business, and "you" includes that business.
2. Who can use CurbCrush
CurbCrush is a professional tool for real-estate agents, brokers and their teams. You must be at least 18 years old and able to enter into a binding contract to use it. The Service is not directed to children and we do not knowingly allow anyone under 18 to create an account.
You may not use CurbCrush if we have previously closed your account for breaking these Terms, or if using it would break the laws that apply to you.
3. Your account
You sign up with your name, an email address and a password. Keep your password private and do not share your account with anyone else. You are responsible for everything that happens under your account, including videos generated and posts scheduled from it. If you think someone else has accessed your account, email us at support@curbcrush.app right away.
Please keep your account and brand details accurate. The name, brokerage, phone number, email, website, headshot and logo in your brand profile appear on your videos, so out-of-date details will be shown to the people who watch them.
4. What CurbCrush does
With CurbCrush you can paste the link to a listing page (for example on Zillow, Realtor.com, Redfin or a brokerage website) or upload your own photos and type in the listing details. We then:
- read the listing page you gave us and copy its facts (such as address, price, beds, baths and square footage) and photos into your account;
- write a short video script from those facts using an AI model;
- record an AI voiceover of the script in the voice you choose;
- render a vertical video with captions, music and your branding, which you can download; and
- if you connect your social accounts, schedule the video to post to platforms such as Instagram, TikTok, YouTube and Facebook.
Some sites block automated access to their pages, so we cannot promise that every link will import. When an import does not work, you can upload the photos and enter the details yourself. We may set reasonable limits on how the Service is used, for example on how many listing pages you can import in an hour, file sizes and the number of photos per listing.
5. Your content and listing information
"Your Content" means everything you submit to CurbCrush or ask us to collect for you: listing links, listing facts and descriptions, photos, your headshot and logo, brand details, script edits and social captions. It also includes the scripts, voiceovers and videos the Service produces for you.
You keep ownership of Your Content. You give CurbCrush a worldwide, non-exclusive, royalty-free licence to host, copy, store, process, adapt (for example resize, crop, caption and combine into a video), transmit and display Your Content only as needed to provide, secure and support the Service for you. That includes sending it to the service providers described in our Privacy Policy and, when you schedule a post, sending your video and caption to the platforms you choose. This licence ends when Your Content is deleted from the Service, except for copies you have already published or shared, and backups that are deleted on their normal schedule.
We do not use Your Content to advertise CurbCrush, and we do not sell it. If we would ever like to feature one of your videos as an example, we will ask you first.
Before a video is made, CurbCrush asks you to confirm your rights to the photos. When you import a listing link, you confirm that you are the listing agent (or have permission from them) and have the rights to use the photos in marketing videos. When you upload photos, you confirm that you took them or have the rights to use them in marketing videos. We record when you gave that confirmation. By giving it, you promise that it is true.
6. Your responsibilities as an agent
You are the professional responsible for your marketing. CurbCrush is a tool; it does not check who owns a listing or a photo and it does not give legal or compliance advice. In particular, you are responsible for:
- Photo and content rights. Only use photos, logos, descriptions and other material you own or are licensed to use for this purpose. Listing photos are often owned by a photographer or brokerage and licensed for limited uses; make sure your use is covered.
- MLS, brokerage and licensing rules. Follow the rules of your MLS, your brokerage and your state licensing authority, including rules about advertising other agents' listings, required brokerage disclosures and how listing information may be displayed.
- Fair housing. Make sure your videos and captions comply with the federal Fair Housing Act and state and local fair housing laws. Do not use CurbCrush to express a preference, limitation or discrimination based on any protected characteristic.
- Accuracy. Check the price, address, room counts, square footage, features and every other fact in your video. Listing pages can be out of date or wrong, imports can misread them, and AI can make mistakes. You are responsible for the accuracy of what you publish.
- Advertising and platform rules. Follow advertising, consumer protection and privacy laws that apply to your marketing, and the rules of each social platform you post to.
7. AI-generated content
CurbCrush uses third-party AI models to write scripts and captions and to generate voiceovers. AI output can be inaccurate, incomplete or inappropriate. It can state facts that are not in the listing, describe a feature wrongly or use wording that does not suit your market. The voiceover is a synthetic voice, not a recording of a real person.
Review every script, caption and video before you download, share or schedule it. You can edit the script and re-render the video. Once you publish a video, it is your statement to the public, and you are responsible for it as if you had written it yourself.
Some platforms require AI-generated content to be labelled. When you post to TikTok through CurbCrush, the video is labelled as AI-generated content. You are responsible for any other disclosures your platforms or local rules require.
8. Posting to social media
You can connect Instagram, TikTok, YouTube and Facebook accounts and schedule videos to them. We do this through Late (also known as Zernio), a social media scheduling provider. When you connect an account, you sign in with the platform and authorize the connection; the platform's access tokens are held by Late, not by CurbCrush.
By connecting an account, you authorize CurbCrush, through Late, to upload videos and publish posts to that account on your behalf, at the times and with the captions and settings you choose. You confirm that you are allowed to post to every account you connect. You can disconnect your accounts at any time in Settings, and you can cancel a scheduled post before it goes out.
Each platform's own terms, community guidelines and policies apply to what you post there, and the platform decides whether to accept, show, limit or remove it. Before a post goes to TikTok, you must choose who can view it, choose whether to allow comments, Duet and Stitch, and confirm that the content complies with TikTok's Music Usage Confirmation. We pass those choices to TikTok as you made them.
We do our best to deliver every scheduled post on time, but publishing depends on Late and on the platforms, which can change their rules, reject a post or be unavailable. We are not responsible for a post that is delayed, rejected or removed by a platform, or for what happens to a video after it is published. Deleting a video in CurbCrush does not remove posts that have already been published; remove those on the platform.
9. Plans, credits and billing
Free trial
New accounts start on a free trial with a small number of video credits (currently 3). No payment card is needed for the trial. Trial credits you have not used stay in your account after the trial period ends.
Paid plans
Paid plans are monthly subscriptions that add a set number of video credits each billing period. Current plans and prices are shown on our pricing section and in Billing inside the app. Prices are in US dollars and do not include taxes unless we say so; you are responsible for any taxes that apply.
Payments are processed by Stripe. When you subscribe, you authorize us (through Stripe) to charge your payment method at the start of each billing period until you cancel. If a payment fails, we may pause the monthly credits for your plan until it is resolved.
How credits work
- Each finished video uses one credit.
- Editing a video's script and re-rendering it does not use another credit, and neither does scheduling it.
- If a video fails before it is finished, the credit for it is returned to your account automatically.
- Unused credits stay in your account when a billing period ends and when you cancel. Credits have no cash value, cannot be transferred or sold, and end when your account is closed.
Cancelling
You can cancel a paid plan at any time from Billing. Cancellation takes effect at the end of the current billing period; you keep your plan's benefits until then and you will not be charged again.
Refunds
Except where the law requires otherwise, payments are non-refundable, including for partial billing periods and for credits you have already used. If you think you were charged in error, email support@curbcrush.app within 30 days of the charge and we will look into it.
Price changes
We may change our plans or prices. If a change affects a plan you are paying for, we will tell you in advance by email or in the app, and the new price will apply from your next billing period after the notice. If you do not agree to the change, you can cancel before it takes effect.
10. Acceptable use
You agree not to use CurbCrush to:
- create videos of listings you are not the listing agent for, unless you have the listing agent's permission;
- upload or import photos, logos, music or other material that you do not have the right to use;
- publish false, misleading or deceptive advertising, including incorrect prices or property details you know to be wrong;
- discriminate, or express a preference or limitation, in violation of fair housing laws, or create content that is hateful, harassing, sexually explicit or violent;
- impersonate another person, agent or brokerage, or misrepresent your licence or your relationship with a listing;
- use the voiceover or other features to imitate a real person's voice without their consent;
- send spam or post to accounts you do not control;
- break the law, or infringe or misappropriate anyone's intellectual property, privacy or other rights;
- use the Service as a general web scraper, to collect data at scale, or to get around limits we set;
- probe, scan or test the security of the Service, interfere with it, or access it by any means other than the interfaces we provide; or
- copy, resell or reverse engineer the Service, or use it to build a competing product.
11. Copyright and infringement notices
We respect intellectual property rights and expect our users to do the same. If you believe that content made or hosted with CurbCrush infringes your copyright (for example, your photos were used in a video without permission), send a notice to support@curbcrush.app with the subject line "Copyright notice" and include:
- your name, address, phone number and email address;
- a description of the copyrighted work you believe has been infringed;
- enough information for us to find the material, such as the listing address, a link to the published video or a screenshot;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law;
- a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf; and
- your physical or electronic signature.
When we receive a valid notice, we may remove or disable access to the material, notify the user who submitted it and, where appropriate, suspend or close their account. Users who repeatedly infringe others' rights will have their accounts closed. If you believe material of yours was removed by mistake, you can reply to our notification with an explanation and we will review it.
Please note that we can only act on content stored in CurbCrush. A video that has already been posted to a social platform has to be reported to that platform as well.
12. Our intellectual property
The Service, including our software, website, templates, motion graphics, bundled music, design, logos and the CurbCrush name, belongs to CurbCrush and our licensors and is protected by intellectual property laws. Apart from Your Content, we do not give you any rights in the Service except the right to use it under these Terms.
Subject to these Terms, you may use the videos CurbCrush renders for you, including the templates, graphics and bundled music built into them, to market your listings and your real estate business, on any channel. You may not extract the templates, graphics or music from your videos and use them separately, or offer them to others.
If you send us feedback or suggestions, we may use them to improve CurbCrush without any obligation to you.
13. Third-party services
CurbCrush relies on other companies to run, including hosting, AI, voice, page retrieval, payment and social scheduling providers. Our Privacy Policy lists them. The Service also links to and works with sites we do not control, such as listing portals and social platforms. We are not responsible for those sites or services, and your use of them is governed by their own terms.
14. Suspension and termination
You can stop using CurbCrush at any time. To close your account, email support@curbcrush.app from the address on your account. If you have a paid plan, cancel it in Billing first so you are not charged again. Our Privacy Policy explains what we delete when an account is closed.
We may suspend or close your account, remove content, or limit your access to features if you break these Terms, if we receive an infringement notice or other credible complaint about your content, if your use creates risk or legal exposure for CurbCrush, other users or third parties, or if we are required to by law. Where reasonable, we will tell you why and give you a chance to fix the problem first, but we may act immediately in serious cases. If we close your account without cause, we will refund the unused portion of any prepaid period.
Sections that by their nature should survive the end of your account, including Your Content licence for copies already published, payment obligations, disclaimers, limitation of liability, indemnity and governing law, continue to apply after it closes.
15. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT ALLOWED BY LAW, CURBCRUSH DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
In plain terms: we work hard to make CurbCrush reliable, but we do not promise that it will always be available, error-free or secure, that every listing will import, that AI output will be accurate, that a post will be accepted or delivered by a platform, or that your videos will bring you leads or sales. Keep your own copies of anything important.
16. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, CURBCRUSH AND ITS OWNERS, EMPLOYEES AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL OR DATA, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF WE HAVE BEEN TOLD THEY ARE POSSIBLE.
TO THE FULLEST EXTENT ALLOWED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) US $100.
Some jurisdictions do not allow certain warranties or damages to be excluded or limited, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
17. Indemnity
You agree to defend, indemnify and hold harmless CurbCrush and its owners, employees and suppliers from any claims, damages, losses and costs (including reasonable legal fees) brought by a third party that arise from Your Content, the videos and posts you publish, your breach of these Terms, or your violation of any law or anyone else's rights, including claims about photo copyright, MLS rules, fair housing or the accuracy of listing information. We will tell you about the claim and may take part in the defence with our own counsel at our own cost.
18. Governing law and disputes
These Terms are governed by the laws of the State of Texas, USA, and applicable US federal law, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Texas, and you and CurbCrush consent to the personal jurisdiction of those courts. Either party may bring a qualifying claim in small claims court instead.
Before filing a claim, please email us at support@curbcrush.app and give us 30 days to try to resolve it informally. Most concerns can be sorted out that way.
If you live in a country whose consumer protection laws give you the right to bring claims in your local courts or under your local law, nothing in this section takes that right away.
19. Changes to the service and these terms
CurbCrush is a young product and will change. We may add, change or remove features, and we may stop offering the Service. If we discontinue the Service entirely, we will give you reasonable notice so you can download your videos, and we will refund the unused portion of any prepaid period.
We may update these Terms from time to time. When we do, we will change the "Last updated" date above. If a change is material, we will give you notice by email or in the app before it takes effect. If you keep using CurbCrush after the change takes effect, you accept the updated Terms. If you do not agree, stop using the Service and close your account.
20. General
These Terms and our Privacy Policy are the entire agreement between you and CurbCrush about the Service and replace any earlier agreements on the same subject. If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a right right away, we have not waived it. You may not transfer your account or these Terms to anyone else without our written consent; we may transfer them as part of a merger, acquisition or sale of assets. We are not liable for delays or failures caused by events outside our reasonable control, such as outages at our providers or the social platforms. Notices to you may be sent to the email address on your account.
